Overview
App Store Manager ("ASM", the "Service") is a SaaS platform that enables app publishers to manage, translate, and submit metadata, screenshots, and other assets to Apple App Store Connect and Google Play Console on their behalf.
By creating an account, starting a free trial, or using any part of the Service, you ("Contractual Partner", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
General Terms and Conditions of the Contractual Partner shall expressly not become part of the contract, even if we do not expressly object to them. Written agreements between the parties take precedence over these Terms.
Our infrastructure relies on the following service providers: Google LLC (Firebase Hosting, Realtime Database, Cloud Functions — EU region europe-west1), Stripe, Inc. (payment processing), and Microsoft Corporation (machine translation API). These providers process data on our behalf as detailed in our Privacy Policy.
Section 1 — General Terms
By agreeing to these Terms you represent that you are of legal age in your country of residence and are legally authorised to enter into a binding contract on behalf of yourself or the organisation you represent.
You may not use the Service for any unlawful purpose or in violation of any applicable law. You must not transmit malicious code, attempt to gain unauthorised access to our systems, or use the Service in any way that could damage, disable, or impair it. A breach of any Term will result in immediate suspension or termination of your access.
Section 2 — General Conditions
We reserve the right to refuse Service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
Your content may be transferred over various networks. Your ASM account credentials and all payment information are always encrypted in transit. App store API credentials you provide are stored encrypted at rest and are never disclosed to third parties except as required to deliver the Service.
Section 3 — Accuracy, Completeness, and Timeliness of Information
Material on this website is provided for general information purposes only and should not be relied upon as the sole basis for business decisions. We reserve the right to modify the contents of this site at any time and have no obligation to update any specific information. Any reliance on the material on this site is at your own risk.
Section 4 — Service Contract, Subscription & Free Trial
Contract conclusion. A contract is concluded and begins upon account creation or first use of the Service.
Free trial. New accounts receive a 14-day free trial with access to the selected plan's features. No charge is made during the trial period. At the end of the trial period, if you have not cancelled, your account will automatically convert to a paid subscription and the applicable fee will be charged to your payment method on file. You may cancel at any time during the trial period without charge.
Subscription & auto-renewal. Paid subscriptions are billed on a monthly or annual cycle as selected at checkout. Your subscription renews automatically at the end of each billing period. If you do not wish to renew, you must cancel before the renewal date via your account settings. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued unless required by law. You will receive a renewal reminder by email at least 5 days before the billing date.
Free plans & promotions. We reserve the right to modify, limit, or discontinue free plans at any time. We will provide at least 30 days' notice before discontinuing a free plan. We shall have no liability for such changes.
Annual subscriptions. If you subscribe on an annual basis, the full annual amount is charged upfront. Cancellation before the annual period ends does not entitle you to a pro-rata refund of the remaining months unless required by applicable law.
Section 5 — Use of the Services
You are granted a limited, non-exclusive, non-transferable right to use the Service during the subscription term. No ownership of the Service, its source code, or any component thereof is transferred to you.
You are responsible for providing all hardware, software, and internet access necessary to use the Service. You must keep your ASM account credentials confidential and notify us immediately of any suspected unauthorised access.
Unless otherwise agreed in writing, each app may only be linked to a single ASM account. Using the same app across multiple accounts is prohibited.
By linking your apps to the Service, you agree to our Privacy Policy.
Section 6 — Store Credentials & API Access
To submit content to Apple App Store Connect or Google Play Console, you must provide ASM with the necessary API credentials — such as Apple API keys or Google Play service account JSON keys ("Store Credentials").
Storage & use. Store Credentials are stored encrypted and are used exclusively to perform the actions you request through the Service (e.g. uploading metadata, screenshots, or app previews). We do not share Store Credentials with any third party except where strictly required by the delivery of the Service.
Your responsibility. You are solely responsible for the Store Credentials you provide. You must ensure that credentials are scoped with the minimum permissions necessary and are valid. We strongly recommend using API-only keys rather than full account credentials where the store provider allows.
Revocation on termination. Upon cancellation or termination of your account you are responsible for revoking or rotating any Store Credentials that were provided to ASM. We will delete stored credentials within 30 days of account closure, but you should not rely on this as a substitute for active revocation.
Liability. We are not liable for any loss, damage, or unauthorised action arising from credentials you provide that are overly permissioned, shared, or compromised through means outside our control.
Section 7 — Store Review Processes & Platform Policies
ASM submits content to Apple App Store Connect and Google Play Console on your behalf. The following conditions apply:
Review & go-live timing. All submissions are subject to the respective store's own review process. Apple and Google review timelines vary and are entirely outside our control — changes may take anywhere from a few hours to several weeks to go live, or may be processed differently depending on the store, the type of change, and the current review queue. ASM makes no guarantee regarding when or whether a submitted change will be approved and published.
Rejection. Apple or Google may reject any submission for any reason in accordance with their respective platform policies. ASM is not responsible for rejections and has no ability to influence store review decisions.
Developer account actions. Apple and Google may at any time suspend, restrict, or terminate your developer account or app listing independently of ASM and without any involvement or fault on ASM's part. ASM has no liability for any such action by Apple or Google, including loss of access to your apps, in-app purchases, or store listings.
Policy compliance. You are solely responsible for ensuring that all content you submit through ASM complies with the applicable store policies:
ASM is not responsible for any violation of store policies caused by content you submit through the Service, and shall not be liable for any resulting account suspension, app removal, or financial loss.
Section 8 — Team Accounts & Sub-Users
Certain plans allow you to invite additional team members ("sub-users") to your account. The account owner is the Contractual Partner and is solely responsible for:
- All actions taken by sub-users within the account
- Ensuring sub-users are aware of and comply with these Terms
- Promptly revoking sub-user access when a team member leaves or no longer requires access
Sub-users have no direct contractual relationship with ASM. Their use of the Service is governed by the account owner's agreement to these Terms. If a sub-user causes a policy violation, the account owner bears full responsibility.
Section 9 — Modifications to the Service and Prices
We reserve the right to modify or discontinue the Service (or any part thereof) at any time. We will provide at least 30 days' advance notice for price increases or material feature removals affecting paid plans. Minor changes (e.g. UI updates, new features) may be made without notice.
If you upgrade your plan during a billing period, the additional cost will be calculated pro-rata for the remaining days and charged immediately. Your next billing cycle will reflect the new plan price in full.
Payments are due on the date of invoice without deduction. You are not entitled to withhold or offset payments based on warranty claims or counterclaims unless such claims are undisputed or have been confirmed by a court of competent jurisdiction.
Section 10 — Right of Withdrawal & Refund Policy
Business customers. If you are acting in your capacity as a business or self-employed professional (Unternehmer, §14 BGB), you have no statutory right of withdrawal. No refunds are issued for partial subscription periods.
Consumer customers (EU). If you are a consumer (Verbraucher, §13 BGB), you have a statutory right to withdraw from this contract within 14 days of conclusion without giving any reason. To exercise this right, contact us at support[at]appstoremanager.net before the 14-day period expires.
Waiver of right of withdrawal. By expressly requesting that the Service begins during the 14-day withdrawal period (e.g. by activating a paid plan or using Service features immediately), you acknowledge and agree that you forfeit your right of withdrawal once the Service has been fully performed, in accordance with §356(4) and §357(9) BGB.
Payment default. If you default on any payment, we may suspend the Service until the outstanding amount is settled. We may declare all outstanding amounts immediately due and payable and charge default interest at the statutory rate applicable to your customer type (§288 BGB: 5 percentage points above the base rate for consumers; 9 percentage points above the base rate for business customers). An administrative reminder fee of EUR 15 per reminder may be charged.
Section 11 — Service Scope & Store Submission Disclaimer
ASM facilitates the preparation and submission of metadata, screenshots, app previews, and related content to app stores. We make reasonable efforts to ensure the Service operates as described, but we cannot guarantee:
- That submitted content will be accepted or approved by the relevant store
- That content will render identically in the store to any preview shown within ASM
- That changes will go live within any specific timeframe
- That the stores' APIs will remain available, stable, or unchanged
We reserve the right to limit access to the Service in specific geographic regions or jurisdictions. All pricing is subject to change with notice as described in Section 9.
Section 11a — Free Tools
We offer free developer tools (such as App Name Search, App Audit, and LLM Website Readiness Check) on our marketing site at appstoremanager.net/tools. These tools are provided "as is" and "as available" without any account or subscription. By using the free tools you agree to the following additional terms:
- No guarantee of accuracy. Results are sourced from third-party APIs (app store search APIs, website crawl data) and may be incomplete, delayed, or inaccurate. We make no representations or warranties regarding the correctness, completeness, or timeliness of the data.
- Not legal or trademark advice. The tools do not constitute brand, marketing, trademark, or legal advice. Always consult a qualified professional before making business decisions based on the results.
- Rate limits. We may impose rate limits, usage caps, or temporary restrictions on the free tools at any time without notice to ensure fair use and service availability.
- No SLA. Free tools have no uptime commitment or support obligations. We may modify, suspend, or discontinue any free tool at any time without notice.
- Liability. Liability for free tools is excluded to the maximum extent permitted by law. In no event shall we be liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the free tools.
Section 12 — Billing & Payment Information
All payment processing is handled by Stripe, Inc. ASM does not store or have access to your full card number, CVV, or banking credentials. By subscribing you agree to Stripe's terms of service.
You agree to provide accurate and up-to-date billing information (name, billing address, payment method). You agree to promptly update your payment details if they change, so we can process renewals without interruption. We reserve the right to suspend access for failed payments after a grace period of 7 days.
Section 13 — Data Retention & Account Deletion
Active accounts. We retain your data (app metadata, screenshots, translations, account settings) for as long as your account is active.
On cancellation. After your subscription ends, your account and data enter a 30-day grace period during which you may reactivate your subscription and recover your data. After this period, your account data will be scheduled for deletion.
On termination for cause. If your account is terminated due to a breach of these Terms, data deletion may occur immediately without a grace period.
Data export. You may export your metadata and app configuration data at any time while your account is active via the export function in the Service. We recommend performing an export before cancelling.
Store credentials. Stored API credentials are deleted within 30 days of account closure. You are independently responsible for revoking credentials within your Apple or Google developer account.
Section 14 — Intellectual Property & User Data Ownership
Your data. All app metadata, screenshots, copy, and other content you upload or create within the Service ("User Content") remains your property. You grant us a limited, non-exclusive licence to process, store, and transmit your User Content solely to provide the Service to you. We do not claim ownership of your User Content and will not use it for any purpose beyond service delivery.
Our intellectual property. The Service, its software, user interface, trademarks, and all related materials are the exclusive property of I WANT AN ELEPHANT UG. Nothing in these Terms transfers any intellectual property rights to you beyond the limited right of use granted in Section 5.
Feedback. If you provide us with feedback or suggestions about the Service, you grant us a perpetual, royalty-free right to use such feedback to improve the Service. We will not attribute feedback publicly without your permission.
Section 15 — Personal Information & Data Processing
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.
GDPR / data processing agreement. If you are a business customer and process personal data through the Service (e.g. user-generated content containing personal information), we act as a data processor on your behalf within the meaning of Art. 28 GDPR. A Data Processing Agreement (Auftragsverarbeitungsvertrag) is available on request at support[at]appstoremanager.net.
Section 16 — Third-Party Services & Links
The Service may integrate with or link to third-party platforms and services (Apple, Google, DeepL, Microsoft Translator, HubSpot, Stripe). We are not responsible for the content, accuracy, availability, or practices of third-party services. Any issues with third-party products should be directed to the relevant third party.
We may provide access to optional third-party tools "as is" and "as available" without warranties of any kind. We have no liability for your use of such tools.
Section 17 — Errors, Inaccuracies, and Omissions
The Service and this website may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct such errors and update information at any time without prior notice.
Section 18 — Prohibited Uses
You are prohibited from using the Service: (a) for any unlawful purpose or in violation of applicable law; (b) to infringe intellectual property rights of others; (c) to submit false, misleading, or fraudulent content to app stores; (d) to upload or transmit malicious code or viruses; (e) to attempt to reverse-engineer, decompile, or extract the source code of the Service; (f) to share account access with unauthorised users or resell access to the Service; (g) to automate or script actions against the Service in a manner that circumvents plan limits or rate limits; (h) to submit content to app stores that violates Apple's or Google's platform policies; or (i) to interfere with or impair the integrity or performance of the Service.
Violation of any prohibited use may result in immediate suspension or termination of your account without refund.
Section 19 — Disclaimer of Warranties; Limitation of Liability
We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
We do not take responsibility for: (a) translated, generated, or submitted content processed through the Service; (b) the outcome of any store review or submission; (c) changes in Apple's or Google's APIs, policies, or processes that affect Service functionality; or (d) actions taken by Apple or Google against your developer account.
To the maximum extent permitted by applicable law, I WANT AN ELEPHANT's total liability for any claim arising out of or related to the Service shall not exceed the total fees paid by you in the 3 months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, loss of data, or business interruption, regardless of the cause.
Section 20 — Indemnification
You agree to indemnify, defend, and hold harmless I WANT AN ELEPHANT UG, its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) content you submit through the Service; (c) your violation of any applicable law or the rights of a third party; or (d) any action taken by Apple or Google against your developer account in connection with content you submitted via ASM.
Section 21 — Termination & Suspension
By you. You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period.
By us — with notice. We may terminate your account with 30 days' written notice for any reason not constituting a breach.
By us — immediate. We may suspend or terminate your account immediately and without notice if you: (i) fail to pay any amount due after a 7-day grace period; (ii) breach Sections 6, 7, 8, or 18 of these Terms; (iii) use the Service in a manner that violates Apple's or Google's platform policies and may expose us to liability; (iv) provide false identity or billing information; or (v) engage in conduct that we reasonably believe is fraudulent or harmful to other users or the Service.
Effect of termination. Upon termination, your right to access the Service ceases immediately. Sections 6, 14, 19, 20, 22, and 23 survive termination. Obligations incurred before termination remain enforceable.
Section 22 — Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
Section 23 — Entire Agreement
These Terms, together with the Privacy Policy and Legal Disclosure, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings, whether written or oral. Our failure to exercise any right under these Terms does not constitute a waiver of that right.
Section 24 — Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for disputes arising out of or in connection with these Terms is Stuttgart, Germany, provided you are a business customer. For consumer customers, mandatory statutory jurisdiction rules apply.
Section 25 — Changes to Terms of Service
We may update these Terms at any time. For material changes affecting your rights or obligations, we will provide at least 14 days' notice by email or via an in-app notification before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
